- Property to be acquired - Specifies what, where and how much. Useful to identify the Broker’s geographic areas when you are looking in multiple regions with more than one Broker
- Agency Relationship - Confirms your approval and understanding of single agency and dual agency representation with your Broker
- Confirmation of agency relationship - Identify when an agency relationship might shift from a Buyer’s Exclusive Agency to a Dual Agency
- Other potential buyers - Provides the required disclosure that the Broker may represent more than one buyer for the same properties you are seeking to acquire
- Non-confidentiality of offers - Buyers are usually unaware and assume that an offer presented to a seller is confidential
- Compensation to Broker - Identify the compensation buyer is obligated to pay Broker (if any) and the compensation protection period beyond the Buyer Representation Agreement expiration date
- Buyer obligation to pay compensation - Confirms if anyone other than the buyer compensates Broker for services covered in this agreement such as the Seller via their MLS Buyer’s Agent Compensation offering, that amount shall be credited toward the buyer obligation to pay compensation. If the amount of compensation exceeds the compensation specified, it shall be disclosed
- Broker authorizations and obligations - Clearly defines what you have authorized and states the Broker’s duties to perform – meets DRE Standard of Care guidelines. Authorizations may be expanded by using Authorization to Receive and Convey Information
- Scope of Broker duty - Clearly defines what duties will and will not be performed by Broker. Provides clarity for you so you know what to expect from the Broker. Meets DRE Standard of Care guidelines. Scope of Duty may be expanded by mutual written agreement using Buyer Material Issues addendum
- Buyer obligations - Clearly defines buyer obligations within the Buyer Representation Agreement
- Dispute resolution - Mediation versus Arbitration – These provisions are also contained in the CAR Purchase Agreement. It is good to know in advance of writing a purchase offer about your options on dispute resolution. Meets DRE Standard of Care guidelines
- Early Cancellation Clause - Allows you to cancel the Representation Agreement any time before entering into a binding contract to purchase a home
